These Terms of Use (“Terms”) govern your use of heroship.com and related pages (the “Site”), operated by Heroship Co. (“Heroship,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
01About Heroship
Heroship provides technology, provider network, pharmacy and operations services to businesses in health and wellness. The Site describes those services and lets businesses contact us and book demos. Use of the Heroship platform itself is governed by a separate written agreement between Heroship and each customer, which controls if it conflicts with these Terms.
02No medical advice
The Site is for general business information only and does not provide medical advice, diagnosis or treatment. Using the Site does not create a provider–patient relationship with Heroship or any clinician. Medical care offered by brands that use Heroship is provided by independently licensed providers. If you have a medical emergency, call 911.
03Eligibility
You must be at least 18 years old to use the Site. If you use the Site on behalf of a company, you confirm that you are authorized to accept these Terms for that company.
04Demos and communications
When you request a demo or contact us, you agree to give accurate information. Meetings are scheduled through a third-party scheduling provider and are subject to availability. By providing your phone number and email, you agree that we may contact you about your request, as described in our Privacy Policy. Reply STOP to opt out of texts at any time.
05Acceptable use
You agree not to:
- Use the Site for any unlawful, fraudulent or harmful purpose.
- Submit false information or impersonate any person or business.
- Interfere with the Site’s security or operation, or introduce malware.
- Scrape, crawl or copy the Site or its content by automated means, except as permitted by search engines.
- Reverse engineer, frame or mirror any part of the Site without our written permission.
06Intellectual property
The Site and its content, including text, graphics, product screens, videos, logos and the Heroship name, are owned by Heroship or its licensors and protected by intellectual property laws. You may view the Site for your own business evaluation. You may not copy, modify, distribute or create derivative works from it without our written permission. If you send us feedback, we may use it without obligation to you.
07Site content and results
Product screens, videos and examples on the Site are for illustration and may include sample data. Statistics and results shown on the Site are averages across brands on Heroship and are not a guarantee of future performance. Your results depend on your business, market and execution. Features and availability may change.
08Third-party services
The Site may link to or include services operated by others, such as scheduling and video tools. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
09Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free.
10Limitation of liability
To the fullest extent permitted by law, Heroship and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
11Indemnification
You agree to defend, indemnify and hold harmless Heroship and its affiliates from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or violation of these Terms.
12Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.
13Changes and termination
We may update these Terms from time to time by posting a new version and changing the “Last updated” date. Your continued use of the Site means you accept the updated Terms. We may suspend or end access to the Site at any time. If any part of these Terms is found unenforceable, the rest stays in effect.
